General terms for electrical installation, alteration, inspection, testing, fault-finding, maintenance, repair, EV charging and associated services supplied in the United Kingdom.

Important

These terms form part of the contract between Briggs Electrical Ltd (we, us or our) and the customer (you or your). They should be read with the relevant quotation, estimate, work order, invoice and any agreed written variation. Nothing in these terms limits rights that cannot lawfully be limited, including a consumer's statutory rights. This is a general commercial document and should be reviewed periodically, and after any material change in law, accreditation requirements or business practice.

1 About these terms

1.1 These terms apply to services and goods supplied by Briggs Electrical Ltd. Company and contact details are those shown on our quotation, work order or invoice.

1.2 A consumer is an individual acting wholly or mainly outside their trade, business, craft or profession. A business customer is any other customer. Clauses expressly stated to apply to one category apply only to that category.

1.3 If the quotation or another written agreement expressly conflicts with these terms, the quotation or written agreement takes priority for that particular work. No oral statement varies the contract unless confirmed by us in writing.

2 Quotations, estimates and formation of contract

2.1 A quotation is based on the information and access available when prepared and remains open for the period stated in it. If no period is stated, it may be withdrawn or revised at any time before acceptance. An estimate is an informed indication, not a fixed price.

2.2 The contract is formed when we accept your instruction, or when you accept the quotation and we confirm the booking, whichever occurs first. Acceptance may be shown by signing, replying with approval, paying a deposit, placing an order, or allowing work to begin after these terms have been provided.

2.3 Use of our services constitutes acceptance of these terms only where they were made available before the contract was formed. Consumer cancellation and information rights continue to apply where required by law.

2.4 Our quotation includes only the work expressly described. Builder's work, decorating, making good, specialist access, asbestos work, network or supplier charges, statutory fees, design by others and removal of hidden obstructions are excluded unless stated otherwise.

3 Scope, standards and compliance

3.1 We will perform the services with reasonable care and skill and in accordance with applicable law and the technical requirements reasonably relevant to the work at the time it is carried out.

3.2 Where applicable, work will follow the current edition of BS 7671, relevant Building Regulations or devolved requirements, manufacturer instructions and the rules or codes applicable to our NICEIC registration and to relevant JIB and ECS requirements. References to NICEIC, JIB or ECS describe applicable professional or scheme requirements; those organisations are not parties to this contract and do not endorse these terms.

3.3 Existing installations do not automatically have to comply with current standards. We may identify departures, defects or recommended improvements that are outside the agreed scope and price.

3.4 We may refuse any instruction that is unsafe, unlawful, contrary to applicable standards, outside our competence, or likely to invalidate a manufacturer's requirements or third-party approval.

4 Customer responsibilities

You must:

  • provide accurate information about the premises, installation, supply characteristics, intended use and known hazards;
  • have authority to instruct the work and obtain any landlord, freeholder, planning, building control, DNO, supplier or other consent not expressly included in our scope;
  • ensure that areas are cleared, accessible and reasonably safe, and that occupants and animals are kept away from the work area;
  • provide water, electricity, welfare and parking facilities where reasonably required and agreed;
  • protect or remove fragile, valuable or sensitive items and back up data or settings that could be affected by isolation or power interruption; and
  • tell us before work begins about asbestos or other hazardous materials, concealed services, alarms, medical equipment, life-safety systems or other special risks.

5 Access, safety and site conditions

5.1 You must provide access at agreed times. We may stop or postpone work if conditions are unsafe or if required access, information, isolation or authority is unavailable. Reasonable resulting costs may be charged.

5.2 Electrical work may require isolation of all or part of the supply. We will take reasonable care, but are not responsible for loss arising solely from an agreed or reasonably necessary isolation where you failed to warn us of critical equipment or take reasonable precautions.

5.3 Reasonable drilling, chasing, lifting of floorboards and disturbance may be necessary. We will take reasonable care. Unless the quotation includes it, final decorative making good, specialist finishes and reinstatement by other trades are excluded.

5.4 We will not disturb material reasonably suspected to contain asbestos or another serious hazard. Work may be suspended until a competent assessment and any necessary removal are completed by others.

6 Price, VAT and payment

6.1 Prices are exclusive of VAT unless stated otherwise. VAT will be charged at the rate applicable when the relevant supply is made.

6.2 Deposits, stage payments, retention and final payment are due as stated in the quotation or invoice. If no due date is stated, the invoice is due on receipt. You may not withhold an undisputed amount because another amount is disputed.

6.3 We may require payment for specially ordered, bespoke or high-value materials before ordering them. A deposit is part-payment, not automatically non-refundable. Any deduction on cancellation will be limited to sums lawfully due for work performed, goods supplied or committed costs and actual loss, as applicable.

6.4 For business customers, we may claim statutory interest, fixed compensation and reasonable recovery costs on late commercial payments where the law permits. For consumers, any late-payment or recovery charge will be fair, proportionate and limited to what the law allows.

6.5 If an invoice is disputed, you must notify us promptly, identify the disputed item and pay the undisputed balance. This does not affect a consumer's statutory rights.

7 Variations and unforeseen work

7.1 A variation includes any change to the agreed design, quantity, route, equipment, timing, access or method of work. Where practicable, we will give the price and time effect before proceeding.

7.2 If urgent action is reasonably necessary to make the installation safe or prevent damage, and it is not practicable to obtain prior approval, we may carry out proportionate temporary safety work and notify you as soon as reasonably possible.

7.3 Hidden defects, inaccessible wiring, non-compliant existing work, inaccurate drawings, structural obstructions, asbestos, supply defects and ground conditions are not included unless expressly allowed for. Additional investigation or remedial work requires approval, except as described in clause 7.2.

8 Materials, equipment and ownership

8.1 We may use equivalent compliant products where a specified item is unavailable, but will seek approval where the substitution materially affects appearance, function, warranty or price.

8.2 Risk in installed goods passes when they are delivered to the site or installed, whichever is later, except where the law provides otherwise. For business customers, ownership of goods supplied by us does not pass until all sums due for those goods are paid in full; this does not entitle us to enter premises or remove installed goods without lawful authority.

8.3 Customer-supplied equipment is installed subject to compatibility, condition and manufacturer information. We are not responsible for defects inherent in customer-supplied goods, but remain responsible for our installation work. Additional time caused by unsuitable, incomplete or defective customer-supplied goods may be charged.

8.4 Removed materials become our property for disposal unless the quotation states otherwise or you ask to retain them before removal. Hazardous waste and items with residual value may be subject to separate arrangements.

9 Programme and delays

9.1 Dates are estimates unless expressly agreed as fixed. We will use reasonable efforts to meet them and keep you informed of material delays.

9.2 We are not liable for delay caused by events outside our reasonable control, including severe weather, supply shortages, utility or DNO action, hidden conditions, unsafe premises, illness, industrial action, transport disruption, third-party delay or changes requested by you. We will take reasonable steps to reduce the effect.

9.3 If you cause delay, abort an appointment or fail to provide access, we may charge reasonable costs and revise the programme.

10 Inspection, testing and certification

10.1 Inspection and testing are limited to the agreed scope and to parts reasonably accessible without destructive investigation unless otherwise stated. Reports describe conditions found at the time and are not guarantees against future faults.

10.2 Certification or reports will be issued where required and after the relevant work, tests and payment obligations have been completed, subject always to any legal duty to provide documents regardless of payment.

10.3 Building Regulations or scheme notification is included only where stated or legally required within our agreed responsibility. Fees and corrective work required because of pre-existing defects or work by others may be additional.

11 Completion, defects and statutory rights

11.1 Work is complete when the agreed services have been substantially performed, notwithstanding minor items that do not prevent safe normal use. We will arrange completion of agreed outstanding items within a reasonable time.

11.2 Notify us promptly of any suspected defect and allow a reasonable opportunity to inspect and, where we are responsible, put it right. This does not reduce any legal remedy available to a consumer.

11.3 We provide no separate fixed-duration workmanship guarantee under these general terms. We remain responsible for the quality of our services and goods to the full extent required by contract and law. Manufacturer guarantees are additional and may require registration or compliance with their conditions.

11.4 We are not responsible for fair wear and tear, misuse, accidental damage, lack of maintenance, unauthorised alteration, faults in existing installations or third-party work, supply disturbances, or defects in customer-supplied goods, except to the extent caused by our breach.

12 Cancellations and postponements

12.1 You may request cancellation or postponement at any time. Your statutory rights, including the consumer rights in clause 13, take priority.

12.2 If less than 24 hours' notice is given for a booked attendance, we may charge a reasonable amount reflecting work already carried out, non-cancellable commitments and actual loss. We will not impose a penalty or recover more than our genuine loss, and will take reasonable steps to reduce that loss.

12.3 Special-order or bespoke goods may not be returnable. Any amount retained or charged will be limited to what is lawful and reasonably evidenced.

13 Consumer cancellation rights

13.1 This clause applies only to consumers where a contract is concluded at a distance, such as by telephone or email, or away from our business premises, such as in your home, and the statutory cancellation rules apply.

13.2 You normally have 14 days from the day after the service contract is made to cancel without giving a reason. For goods contracts, different timing may apply based on delivery. We will provide the required pre-contract information and cancellation information.

13.3 To cancel, send a clear statement to the contact details on our quotation or invoice. You may use the form in Appendix A but do not have to.

13.4 We will not begin services during the 14-day cancellation period unless you make an express request. If you requested an early start and then cancel, you must pay a proportionate amount for services supplied up to cancellation. If the service is fully performed during the cancellation period after your express request and acknowledgement, the statutory right to cancel the fully performed service may be lost.

13.5 The right to cancel may not apply, or may be limited, for urgent repairs or maintenance specifically requested at your home, and for bespoke goods, to the extent provided by law. Additional work or goods beyond an urgent request remain subject to the usual rules.

14 Suspension and termination

14.1 We may suspend work on reasonable notice if an amount remains overdue, instructions are not provided, the site is unsafe, access is denied, required consent is absent, or continuing would be unlawful. In an emergency, suspension may be immediate.

14.2 Either party may end the contract for a serious breach that is not remedied within a reasonable period after written notice, or immediately where the breach cannot be remedied. Ending the contract does not affect accrued rights.

14.3 On termination, you must pay sums properly due for work completed, goods supplied or ordered, reasonable demobilisation and other recoverable loss, subject to consumer law and our duty to mitigate loss.

15 Liability

15.1 Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that law does not permit us to exclude.

15.2 We are responsible for loss or damage that is a reasonably foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss caused by inaccurate information, hidden defects, unsafe existing work or a failure by you or a third party, except to the extent we caused or contributed to it.

15.3 For consumers, we do not exclude liability for damage to property caused by our failure to use reasonable care and skill. We are not liable for business losses suffered by a consumer.

15.4 For business customers only, and subject to clause 15.1, neither party is liable for indirect or consequential loss, loss of profit, revenue, business, contract, goodwill, anticipated saving or data. Any further liability cap must be stated in the quotation or separately agreed in writing; no unstated cap is created by these terms.

16 Insurance, subcontractors and third parties

16.1 We will maintain insurance appropriate to our business and legal obligations. Evidence may be provided on reasonable request.

16.2 We may use suitably competent employees or subcontractors and remain responsible for performance of our contractual obligations. Certain manufacturers, utilities, network operators or certification bodies act independently and are not our subcontractors.

16.3 No person other than you and us has a right to enforce this contract, except where the law expressly provides otherwise.

17 Complaints

17.1 Raise any concern promptly using the contact details on our quotation or invoice. Please provide the site address, description of the issue, relevant dates and supporting photographs or documents. We will acknowledge, investigate and seek to resolve the matter within a reasonable time.

17.2 Where work falls within an applicable NICEIC complaints or warranty process, you may be able to refer an unresolved technical complaint in accordance with the scheme's current eligibility rules and procedure. We will provide relevant registration information on request. This does not remove court rights or mandatory consumer remedies.

18 Data protection

18.1 We process personal information to prepare quotations, administer contracts, perform work, issue certification, keep legal and accounting records, manage safety and insurance, and communicate about our services. We will process it in accordance with applicable UK data protection law.

18.2 We may share necessary information with employees, subcontractors, professional advisers, certification or competent-person schemes, building control, network or energy providers, manufacturers and authorities where required for the work or by law. Further information should be set out in our privacy notice.

19 General provisions

19.1 Notices may be sent by hand, post or email to the latest contact details supplied. Routine operational messages may also be sent by text or another agreed channel.

19.2 If any provision is invalid or unenforceable, it will be adjusted or removed only to the minimum extent necessary; the remaining provisions continue.

19.3 A delay in exercising a right is not a waiver. You may not transfer the contract without our written agreement, except where the law provides otherwise. We may transfer it only where this does not reduce a consumer's rights or protections.

19.4 These terms and the documents identified in clause 1.3 form the entire agreement. This does not exclude liability for fraud and does not bind a consumer to wording that is unfair or inconsistent with mandatory pre-contract information.

20 Governing law and courts

20.1 The contract is governed by the law of the part of the United Kingdom most closely connected with the work and the customer, subject to mandatory consumer protections.

20.2 As Briggs Electrical Ltd is based in Wales, contracts performed in England and Wales will normally be governed by the law of England and Wales and disputes may be brought in its courts. A consumer may bring proceedings in any court available to them under mandatory law, including the courts of the part of the UK where they live.
